Comfort Conveyancing Pty Ltd ("we", "us", "our") is committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), and other applicable laws. This Privacy Policy explains how we collect, use, disclose and store your personal information when you engage our services, complete our electronic onboarding process or visit our website.

  2. How We Collect Your Information
    We collect personal information:
    • Directly from you via phone, email, website forms, electronic onboarding or meetings
    • Through secure electronic systems including InfoTrack, PEXA, identity verification providers, AML/CTF compliance platforms and other service providers used in connection with your conveyancing transaction.
    • From real estate agents, lenders, brokers, solicitors or other parties involved
    • From publicly available registers such as Land Registry Services, councils or water authorities
    • When you provide documents required for your conveyancing matter

  3. Why We Collect Your Information
    We collect personal information for purposes including:
    • Providing conveyancing services
    • Verifying your identity
    • Conducting customer due diligence and complying with our obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)
    • Conducting sanctions screening, politically exposed person (PEP) screening and other AML/CTF compliance activities where required by law
    • Assessing whether we are able to act or continue acting on your behalf in accordance with our legal obligations
    • Conducting searches, preparing contracts and managing your matter
    • Complying with legal and regulatory obligations
    • Completing electronic settlements
    • Communicating with you throughout your matter
    • Managing billing, invoices and payments
    • Meeting AIC NSW and trust accounting requirements

  4. How We Use and Disclose Your Information
    We may disclose information to:
    • Other parties involved in the transaction such as solicitors, real estate agents and brokers
    • Financial institutions and mortgagees
    • PEXA and other electronic settlement services
    • InfoTrack and identity verification, AML/CTF compliance or search providers
    • Surveyors, valuers, councils, water authorities and strata managers
    • NSW Fair Trading, Land Registry Services, Revenue NSW, AUSTRAC and other regulators where authorised or required by law
    • IT, cloud hosting, software and cyber security providers who support our business operations
    We do not sell your information.

  5. Overseas Disclosure
    Some of our third-party service providers may store or process personal information using cloud-based systems located outside Australia. Where this occurs, we take reasonable steps to ensure those providers handle your personal information in accordance with applicable privacy laws.

  6. Security of Your Information
    We follow AIC NSW best-practice security measures including encrypted storage, secure communication systems, password protection, multi-factor authentication, restricted staff access and regular system reviews.     We also use secure third-party providers to facilitate identity verification, customer due diligence, AML/CTF compliance and electronic conveyancing. We maintain reasonable technical and organisational safeguards designed to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

  7. Retention of Records
    Under the Conveyancers Licensing Act 2003 (NSW), the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and AIC NSW guidelines:
    • Conveyancing files, trust records and records required to be retained under applicable legislation must be kept for at least 7 years, or such longer period as required by law. After this period, records may be securely destroyed.

  8. Access and Correction
    You may request access to or correction of personal information we hold about you. We may require identification to ensure security. Requests should be made using our contact details below. We will respond to requests within a reasonable time unless an exception under the Privacy Act applies.

  9. Anonymity and Pseudonyms
    Where lawful and practical, you may choose not to identify yourself or to use a pseudonym when making a general enquiry. However, if you engage us to provide conveyancing services, we are generally required by law to identify you and verify your identity. Accordingly, it will not usually be possible for us to provide conveyancing services anonymously or under a pseudonym.

  11. Marketing Communications
    We may send you updates or information related to conveyancing services. You may opt out at any time by contacting us.
